Terms & Conditions.
1. General Provisions
1.1. These Terms and Conditions (hereinafter referred to as the “Terms”) govern the use of the online store website, as well as the purchase of goods through the website.
1.2. The seller of the goods is Sole Proprietor Maksym Serhiiovych Yermakov, Tax ID 3871007510 (hereinafter referred to as the “Seller”).
1.3. By using the website, viewing its pages, or placing an order, the Buyer confirms that they have read and agreed to these Terms.
1.4. The Seller has the right to amend these Terms. A new version becomes effective from the moment it is published on the website, unless otherwise provided by the legislation of Ukraine.
2. Product Information
2.1. Information about the goods published on the website includes the product name, description, specifications, package contents, price, and other information necessary for making a purchase decision.
2.2. Product photographs on the website may be illustrative. The color and appearance of the product may slightly differ from the images depending on monitor settings, lighting, and other technical factors.
2.3. The Seller makes every effort to ensure that the information on the website is up to date; however, technical errors or inaccuracies may occur.
2.4. If a material error is discovered in the price, specifications, or availability of a product, the Seller has the right to contact the Buyer to clarify the order.
3. Placing an Order
3.1. The Buyer may place an order through the functionality of the website or by another method offered by the Seller.
3.2. When placing an order, the Buyer undertakes to provide accurate and up-to-date information necessary for its fulfillment.
3.3. After the order is placed, the Buyer may receive a confirmation at the provided phone number or email address.
3.4. The Seller has the right to contact the Buyer to confirm the order, clarify details, delivery method, or other information.
3.5. The order is considered accepted for processing after confirmation by the Seller.
3.6. If the product is unavailable, cannot be supplied, or other circumstances arise, the Seller will notify the Buyer and may offer an alternative product, change the delivery period, or cancel the order.
4. Product Price
4.1. The price of each product is indicated on the website in Ukrainian hryvnia, unless otherwise expressly stated in the product description.
4.2. Unless otherwise stated on the website, the product price does not include delivery costs.
4.3. The Seller has the right to change product prices. The price agreed upon when the order is confirmed may not be changed unilaterally after confirmation, except in cases provided by the legislation of Ukraine.
4.4. If promotions, promo codes, or discounts apply, the conditions of their use are specified on the website.
5. Payment
5.1. Payment for goods may be made by the following methods:
- online bank card payment;
- bank transfer using account details;
- cash on delivery upon receipt, if available;
- another method specified on the website.
5.2. When paying by bank card, the payment may be processed through a third-party payment service.
5.3. The Seller does not receive or store the Buyer’s full bank card details, unless otherwise provided by the relevant payment service.
5.4. The order may be transferred for delivery after payment has been confirmed or under other agreed terms.
6. Delivery
6.1. Goods are delivered by the methods available when placing the order.
6.2. The delivery cost is determined in accordance with the rates of the selected delivery service or the terms specified on the website.
6.3. The estimated delivery time depends on the selected delivery method, destination, product availability, and other circumstances.
6.4. The Seller is not responsible for delays caused by delivery services, transport restrictions, emergencies, or other circumstances beyond the Seller’s control.
6.5. Upon receipt of the goods, the Buyer is advised to check the integrity of the packaging and the conformity of the received goods with the order.
6.6. If damage to the packaging or goods is discovered, the Buyer is advised to document the damage and contact both the delivery service representative and the Seller.
7. Receipt of Goods
7.1. The Buyer has the opportunity to inspect the goods upon receipt in accordance with the terms of the selected delivery service.
7.2. Receipt of the goods by the Buyer or a person authorized by the Buyer confirms the transfer of the goods, but does not deprive the Buyer of the rights provided by Ukrainian law regarding warranty, product defects, and returns.
8. Exchange and Return of Goods
8.1. The Buyer has the right to exchange or return goods in the cases and within the periods provided by the legislation of Ukraine.
8.2. To arrange a return, the Buyer must contact the Seller using the contact details specified on the website and provide the order number and the reason for the request.
8.3. Returned goods must comply with the requirements of the legislation concerning the return of goods.
8.4. Certain categories of goods may not be subject to exchange or return in accordance with the legislation of Ukraine.
8.5. If the product is defective or does not correspond to the order, the Seller will consider the Buyer’s request in accordance with the requirements of Ukrainian law.
8.6. Refunds are made in the manner and within the time limits provided by Ukrainian law and these Terms.
9. Warranty
9.1. Goods for which the manufacturer or Seller has established a warranty period are covered by the applicable warranty conditions.
9.2. For warranty service, the Buyer must contact the Seller and provide information about the order and, if necessary, documents confirming the purchase.
9.3. The warranty does not cover damage caused by improper use, mechanical damage, violation of operating rules, or other cases provided by the manufacturer’s warranty terms and Ukrainian law.
10. Personal Data
10.1. When placing an order, the Buyer may provide personal data, including name, phone number, delivery address, and email address.
10.2. The Seller processes personal data in accordance with the legislation of Ukraine and the Privacy Policy published on the website.
10.3. Personal data may be used for:
- placing and fulfilling orders;
- communication with the Buyer;
- arranging delivery;
- processing payments and refunds;
- warranty and service support;
- fulfilling other obligations related to the sale of goods.
10.4. Personal data may be transferred to third parties in the cases and to the extent necessary for order fulfillment or as required by Ukrainian law.
11. Intellectual Property
11.1. Website content, including texts, photographs, graphic materials, logos, design, software code, and other materials, may be protected by intellectual property rights.
11.2. Copying, reproducing, distributing, or using website materials without the appropriate permission of the rights holder is prohibited, except in cases provided by law.
12. Liability
12.1. The Seller is not responsible for temporary website unavailability, technical failures, Internet disruptions, or other circumstances beyond the Seller’s reasonable control.
12.2. The Seller is not responsible for consequences resulting from the Buyer’s use of the product in violation of the manufacturer’s instructions or operating rules.
12.3. In the event of a dispute, the parties will attempt to resolve it through negotiations, and if an agreement cannot be reached, in accordance with the legislation of Ukraine.
13. Force Majeure
13.1. The parties are released from liability for failure to perform or improper performance of obligations if such failure results from force majeure circumstances that arose after the conclusion of the agreement and which the parties could not reasonably foresee or prevent.
13.2. Such circumstances may include, in particular, natural disasters, fires, military actions, epidemics, decisions of government authorities, disruptions in transport or energy infrastructure, and other circumstances meeting the requirements of Ukrainian law.
